1. Agreement to Terms

By accessing or using the Spawful Pets platform ("Service"), operated by Spawful Pets, Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including business owners, staff members, and end customers who interact with the booking portal.

2. Description of Service

Spawful Pets provides a cloud-based business management platform designed for pet grooming businesses. The Service includes, but is not limited to: appointment scheduling, client and pet management, point of sale, invoicing, communications, reports, online booking, and marketing tools.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or the business entity you represent.

4. Subscription and Billing

The Service is offered on a monthly subscription basis. By subscribing, you authorize us to charge the payment method on file at the beginning of each billing cycle. Subscription fees are non-refundable except as required by law or as described in our refund policy.

• Free trials may be offered for a limited time and convert to paid subscriptions unless cancelled.
• We reserve the right to change subscription pricing with 30 days written notice.
• Failure to pay may result in suspension or termination of your account.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Transmit any malware, viruses, or other harmful code.
• Attempt to gain unauthorized access to any portion of the Service.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to store or transmit content that violates the rights of others.
• Resell, sublicense, or redistribute the Service without written authorization.

6. Data Ownership

You retain all rights to the data you enter into the Service ("Your Data"). We do not claim ownership of Your Data. You grant us a limited license to host, store, and process Your Data solely for the purpose of providing the Service to you.

You may export Your Data at any time through the Service's export functionality. Upon account termination, Your Data will remain accessible in read-only mode for 30 days, after which it may be permanently deleted.

7. Payment Processing

The Service integrates with third-party payment processors to facilitate payment acceptance. We are not responsible for the actions or omissions of third-party payment processors. Your use of payment processing features is subject to the terms and conditions of the applicable payment processor.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

9. Limitation of Liability

To the maximum extent permitted by law, Spawful Pets, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

10. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through your account settings. We may suspend or terminate your account if you violate these Terms or for any other reason with reasonable notice.

Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination will survive, including ownership, warranty disclaimers, and limitations of liability.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Travis County, Texas.
